5. Intellectual Property Rights

Your Content

You retain ownership of the prompts you submit and videos you generate. By generating content through our Service, you grant us a limited license to:

• Store and process your content to provide the Service
• Use anonymized data to improve our AI models
• Display content you choose to share publicly in our Showcase

Commercial Use

Free Tier: Personal use only, no commercial rights.
Pro & Enterprise: Full commercial usage rights, including advertising, marketing, and resale of generated videos.

6. Payment and Billing

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except where required by law
• We offer a 14-day money-back guarantee for first-time Pro subscribers
• Prices may change with 30 days' notice to existing subscribers
• Failure to pay may result in service suspension or termination
• You authorize us to charge your payment method for all fees

7. Service Availability and Support

We strive to provide reliable service but cannot guarantee:

• Uninterrupted or error-free operation
• That defects will be corrected immediately
• Specific uptime percentages (except Enterprise SLA customers)

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

8. API Usage Terms

• API keys are confidential and must not be shared
• You must comply with rate limits for your tier
• Excessive API abuse may result in throttling or suspension
• We may monitor API usage to ensure compliance and quality

9. Disclaimer of Warranties

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLING GENERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Kling Generator and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent activity or payment issues
• At our sole discretion for any other reason

You may cancel your subscription at any time through your account settings. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.
